1) Contract
These Terms govern your access to and use of https://www.nicetocuhawaii.com/ and our mobile apps. By using the Services you agree to these Terms and our Privacy Policy.
2) Eligibility
You must be at least 13. If you are 13–17, you represent you have parental or guardian consent. The Services are for personal, lawful use.
3) Accounts and Security
Provide accurate information and keep it current. Keep your credentials confidential. You are responsible for activity on your account. Tell us right away about unauthorized use.
4) License to Use the Apps and Site
We grant you a limited, nonexclusive, nontransferable, revocable license to use the Services for personal use, subject to these Terms and any app store rules.
iOS App Terms. If you download from Apple: your use is also governed by Apple’s Standard EULA; Apple is a third‑party beneficiary with the right to enforce that EULA.
Google Play Terms. If you download from Google Play: your use is also subject to Google Play Terms of Service.
5) Purchases, Payments, and Pricing
In‑app purchases or orders may be processed by Apple, Google, or our payment processors. Taxes may apply. We may correct pricing errors. All sales, refunds, and billing follow the applicable app store terms and our posted policies.
6) Loyalty Program
Program rules are posted in the app or site. We may change or end the program consistent with those rules.
7) User Content and Feedback
If you submit reviews, feedback, or other content, you grant us a worldwide, royalty‑free, transferable license to use, reproduce, modify, and display it for operating and improving the Services. Do not submit content you do not have rights to or that violates law.
8) Acceptable Use
Do not:
- Interfere with or disrupt the Services.
- Access or scrape the Services by automated means without permission.
- Reverse engineer or attempt to derive source code except as allowed by law.
- Upload malicious code or violate security.
- Misuse coupons, offers, or loyalty features.
- Infringe others’ rights.
9) Ownership
We own the Services and all IP rights in them. The CU brand and related marks are our trademarks or those of our affiliates or licensors.
10) Third‑Party Services and Links
Third‑party services have their own terms and privacy practices. We are not responsible for them.
11) Mobile Features
The apps may request permissions for location and notifications. You can manage permissions in your device settings.
12) Termination
We may suspend or terminate access if you violate these Terms or for security or operational reasons. You may stop using the Services at any time. Sections that by nature should survive will survive.
13) Warranty Disclaimer
The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law.
14) Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim is limited to the greater of $100 or the amount you paid to us in the 12 months before the claim.
15) Indemnification
You will indemnify and hold harmless CU Hawaii and our affiliates, officers, employees, and agents from claims arising out of your use of the Services or violation of these Terms.
16) Dispute Resolution; Arbitration; Class‑Action Waiver
Informal Process. Contact us first to try to resolve a dispute.
Arbitration. If unresolved, disputes will be resolved by binding arbitration on an individual basis under the Rules of the American Arbitration Association. You waive jury trial. Either party may seek injunctive relief in court for IP or misuse of the Services.
Class‑Action Waiver. Disputes must be brought in your individual capacity, not as a class or representative action.
Opt‑Out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with your name and the email tied to your account.
Some jurisdictions do not allow mandatory arbitration or waivers; if a court finds these unenforceable, those parts will not apply.
17) Governing Law and Venue
Hawaii law governs these Terms, without regard to conflict of laws. Venue for any permitted court action is the state or federal courts in Honolulu County, Hawaii.
18) Apple‑Specific Terms
You acknowledge these Terms are between you and CU Hawaii only, not Apple. Apple has no obligation to furnish maintenance or support. In the event of failure of the iOS app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third‑party beneficiaries of these Terms as they relate to the iOS app and may enforce them.
19) Google‑Specific Terms
You acknowledge these Terms are between you and CU Hawaii only. Google is not responsible for support of the Android app. Your use of Google Play is subject to Google Play Terms.
20) Export and Sanctions
You may not use or export the apps in violation of U.S. export laws or sanctions.
21) DMCA / Copyright Complaints
If you believe content infringes your copyright, send a notice with: (1) your signature, (2) identified work, (3) location of the material, (4) contact information, (5) a statement of good‑faith belief, and (6) a statement under penalty of perjury of accuracy and authority.

22) Changes to the Services and Terms
We may change or discontinue features. We may update these Terms. Continued use after the effective date means you accept the changes.
